Terms of Service
These Terms govern your use of services provided by CCTC Travel Group, LLC d/b/a Cupcake Castles Travel Company ("CCTC," "we," "us," "our").
1. Acceptance of terms
By accessing our website, requesting a quote, signing a card authorization, or booking travel with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
2. Our role as a travel advisor
CCTC acts as an independent travel advisor and intermediary between you and travel suppliers (airlines, cruise lines, resorts, tour operators, ground transportation providers, and others). We do not own, operate, or control any travel supplier. All bookings are subject to the terms, conditions, and cancellation policies of the applicable supplier.
3. Quotes and bookings
- Quotes are estimates based on supplier-published pricing at the time of quote and are not guaranteed until deposit is paid and booking is confirmed.
- Pricing, availability, and supplier promotions can change without notice prior to confirmation.
- You are responsible for reviewing all confirmation documents and notifying us of any errors within 24 hours of receipt.
4. Payments
- Deposits and final payments are due per the supplier's published schedule. Late payment may result in cancellation by the supplier.
- CCTC does not process credit card payments from clients. By submitting a signed card authorization form, you authorize the named travel supplier to charge your card for the amounts described, plus any additional amounts you subsequently approve in writing (email, text, signed form). CCTC's role is limited to securely transmitting your authorization to the supplier.
- All credit card charges appear on your statement under the applicable supplier's name, not CCTC.
- Group bookings. In limited cases (typically group cruise or resort bookings), CCTC may accept payment from the lead traveler by paper check and then pay suppliers from CCTC's own funds on the group's behalf. This is the only circumstance in which CCTC receives client funds directly.
- Chargebacks initiated without first contacting CCTC to resolve a dispute may result in collection action and forfeiture of supplier credits.
5. Cancellations, changes, and refunds
Cancellation and change penalties are set by the supplier and described in your booking documents. CCTC does not have the authority to waive supplier penalties. Refunds, when issued, are processed by the supplier on their published timeline. Any planning or service fees charged directly by CCTC are non-refundable once work has begun.
6. Travel insurance
We strongly recommend travel protection insurance for every booking. By declining coverage on your card authorization form, you accept full financial responsibility for any losses caused by trip cancellation, interruption, medical emergency, baggage loss, weather, or supplier default.
7. Travel documents and identification
You are solely responsible for ensuring that every traveler has the required passport, visa, vaccinations, and other entry documents for each destination. CCTC is not responsible for missed travel, denied boarding, or denied entry resulting from inadequate documentation. Consult travel.state.gov and cdc.gov/travel for current requirements.
8. Assumption of risk and limitation of liability
Travel involves inherent risks including but not limited to weather, illness, accident, terrorism, civil unrest, supplier default, and Acts of God. CCTC shall not be liable for any injury, loss, damage, delay, or cancellation arising from acts or omissions of any travel supplier, government, or third party, or from circumstances beyond our reasonable control.
To the maximum extent permitted by law, CCTC's total liability for any claim arising out of or related to our services is limited to the planning or service fees you paid directly to CCTC for the booking in question (not including amounts paid to suppliers).
9. Photo, review, and content release
If you share photos, reviews, or testimonials with CCTC, you grant us a non-exclusive, royalty-free license to use them for marketing purposes including our website, email, and social media, with credit when requested.
10. Intellectual property
All website content, branding, photography (other than user-submitted), and copy are owned by CCTC or our licensors. Disney artwork, logos, and properties are © Disney. You may not reproduce or distribute our content without written permission.
11. State Seller of Travel disclosures
Florida Seller of Travel Registration No. ST42417. California Seller of Travel Registration No. 2143399-40 (CCTC is not a participant in the California Travel Consumer Restitution Fund). Washington Unified Business ID (UBI) #604 562 798.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms shall be resolved by binding arbitration in Hillsborough County, Florida, except that either party may bring a small-claims action in their local jurisdiction.
13. Changes to these terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
